Delegated Authority
Section 5.42 of the Local Government Act 1995 (The 'Act') allows Council to delegate any of its powers or duties to the Chief Executive Officer and section 5.44 of the Act allows the CEO to sub-delegate any of these powers or duties to Shire officers. Section 5.43 stipulates the powers and duties that cannot be delegated to the CEO.
There are strict guidelines surrounding the reporting process for officers to whom powers are delegated. Each time a delegation is used, the officer is required to keep a written record and these records are checked by the Office of the CEO on a quarterly basis.
Section 5.46(2) of the Act requires Council to review each of its delegations every financial year. The review is completed by the Office of the CEO in consultation with all relevant officers and a report is submitted to Council for their consideration.
